1. Introduction
This Acceptable Use Policy ("AUP") sets out the rules and restrictions that apply to your use of the services, platform, and applications provided by Ethena Pay Ltd. ("Company," "we," "us," or "our"). This AUP forms part of and is incorporated into our Terms and Conditions. Capitalised terms not defined here have the meanings given to them in the Terms and Conditions.
2. General Requirements
When using the Services, you must:
comply with all applicable laws, regulations, and industry standards in your jurisdiction;
comply with the Terms and Conditions and all Additional Documents;
- provide accurate, complete, and up-to-date information when requested;
- use the Services only for lawful purposes and in good faith; and
cooperate with any reasonable requests from us relating to security, compliance, or investigations.
3. Prohibited Activities
You must not use the Services, directly or indirectly, to:
3.1 Financial Crime
- engage in money laundering, terrorist financing, or proliferation financing;
evade or attempt to evade economic or trade sanctions imposed by the European Union, United Nations, United States, United Kingdom, or any other applicable authority;
- structure transactions to avoid reporting thresholds or compliance controls;
- facilitate tax evasion or fraudulent tax schemes; or
- process transactions that you know or suspect involve the proceeds of crime.
3.2 Fraud and Deception
- engage in fraud, identity theft, or impersonation;
- use stolen, forged, or unauthorised payment credentials, accounts, or identity documents;
- submit false, misleading, or deceptive information;
create accounts under false identities or maintain multiple accounts without authorisation; or
- manipulate or abuse referral programs, promotions, or reward mechanisms.
3.3 Illegal Goods and Services
purchase, sell, or facilitate the trade of illegal drugs, narcotics, or controlled substances;
- purchase, sell, or facilitate the trade of illegal weapons, ammunition, or explosives;
- purchase, sell, or facilitate the trade of stolen goods or counterfeit products;
- facilitate illegal gambling or unlicensed gaming operations; or
- engage in or facilitate any activity involving child exploitation, abuse, or trafficking.
3.4 Market Abuse
- engage in market manipulation, wash trading, spoofing, or layering;
- use insider information to trade or transact;
- conduct abusive trading practices that distort the fair operation of the Services; or
- exploit pricing errors, system vulnerabilities, or latency in bad faith.
3.5 Platform Integrity
access or attempt to access the Services through unauthorised means, including hacking, scraping, or reverse engineering;
- introduce viruses, malware, or other malicious code into the Platform;
- interfere with, disrupt, or overload the Platform or its infrastructure;
- attempt to circumvent security measures, access controls, or transaction limits;
use automated systems, bots, or scripts to interact with the Services without our prior written consent; or
- access or use another user's account without authorisation.
3.6 Restricted Industries
Unless expressly authorised by us in writing, you must not use the Services in connection with:
- unlicensed money transmission or payment services;
- unregistered securities offerings or investment schemes;
- adult entertainment or sexually explicit content;
- multi-level marketing or pyramid schemes;
- binary options, contracts for difference, or similar high-risk speculative products; or
- any industry or activity that is prohibited or restricted in your jurisdiction.
4. Compliance with Sanctions and Restricted Jurisdictions
You must not use the Services if you are:
located in, resident in, or a national of a country or region subject to comprehensive economic sanctions;
designated on any sanctions list maintained by the European Union, United Nations, United States (including OFAC), United Kingdom, or any other applicable authority; or
owned or controlled by, or acting on behalf of, any person or entity described in (a) or (b).
We may restrict access to the Services from certain jurisdictions at our discretion, based on legal, regulatory, or risk considerations.
5. Monitoring and Enforcement
We reserve the right to monitor your use of the Services to ensure compliance with this AUP. If we reasonably believe that you have violated this AUP, we may, without prior notice where permitted by law:
- issue a warning;
- restrict, suspend, or terminate your access to the Services;
- reverse, cancel, or block transactions;
- report the activity to law enforcement or regulatory authorities; or
take any other action we consider appropriate to protect the Company, other users, or third-party service providers.
6. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at support@ethenapay.co or through our support page.
7. Changes to This Policy
We may update this AUP from time to time. Changes will be posted on the Platform and, where required by applicable law, communicated to you in advance. Your continued use of the Services following any update constitutes acceptance of the revised AUP.
